Buyer Terms
Version 2.4 · Visionary Studios / MTSTGEORGE LTD · October 2026
At a Glance
What buyers need to know
- Payments: The platform facilitates card payment via Stripe and, for acquisitions of €2,500 or above, bank transfer to a unique Stripe-generated virtual bank account that settles directly into the seller's connected Stripe account. In both cases funds go directly to the seller - Visionary Studios does not hold or control your funds at any stage.
- Bank Transfer (€2,500+): For high value purchases, direct bank transfer via Stripe is available. Identity verification required. Your artwork is reserved for a limited window while you complete the transfer, and your order confirms automatically once funds clear - no seller approval needed. See Section 2a for full terms.
- Split Payment: On eligible single-artwork purchases, you may pay part by card and the rest by bank transfer (€100 minimum on each side), with the order confirming once both parts clear. See Section 2b for full terms.
- Purchases & Auctions: Completed purchases and winning bids are binding commitments. Auction bids are irrevocable once placed.
- Shipping: The seller is solely responsible for packaging, insuring, and delivering your artwork. Delivery timelines and carriers are agreed directly between you and the seller.
- Disputes & Refunds: If something goes wrong, open a Refund Request from your Orders page. The seller has 72 hours to approve or decline it. If the seller does not respond within 72 hours, Visionary Studios may process the refund on your behalf as a procedural step — not a ruling on who was right. Separately, you may always escalate to your card issuer for a chargeback. Visionary Studios does not adjudicate disputes; chargeback outcomes are determined independently by Stripe and your issuing bank.
- Your Rights: Nothing in these terms removes your statutory rights under EU or Irish consumer law, including rights to conforming goods and statutory remedies against the seller.
- Non-delivery: If your artwork does not arrive, contact the seller, then escalate to support@visionarystudios.art. You retain the right to raise a payment dispute with your card issuer.
- Presentation imagery: Homepage and editorial imagery may show artworks in digitally staged or AI-assisted settings that do not depict real locations, actual framing, or actual condition. The listing itself is always the authoritative representation of the work. See Section 4c.
This summary is provided for convenience only and does not form part of the legally binding terms. Please review the full terms below.
1. Platform Role - Neutral Infrastructure
Visionary Studios operates solely as a neutral technology platform providing listing, discovery, and communication infrastructure.
- The platform is not a buyer, seller, agent, broker, intermediary, fiduciary, or representative of any user
- The platform does not participate in, control, or influence transactions, negotiations, fulfilment, delivery, or dispute resolution between users
- All transactions are conducted directly between users, who act as independent contracting parties
- Any tools, records, or system-generated data made available by the platform are provided on a neutral, non-interpreted basis for informational purposes only
- Use of the platform does not create any partnership, joint venture, agency, or fiduciary relationship between Visionary Studios and any user
Visionary Studios operates as an online marketplace connecting independent artists (sellers) with collectors (buyers).
- The platform does not own, hold, or sell artworks
- All transactions occur directly between buyer and seller
- The platform facilitates card payment via Stripe and, for eligible purchases, bank transfer via a Stripe-generated virtual bank account that settles directly into the seller's connected Stripe account
Visionary Studios is not a party to the sale contract between buyer and seller.
2. Payments
2.1 Payment Processing
The platform facilitates two payment routes. Card payments are processed securely through Stripe and are available for all purchases; for purchases of €2,500 or above, buyers may also elect to pay by direct bank transfer, processed by Stripe directly into the seller's own connected Stripe account - see Section 2a below.
- Card payments go directly to the seller's connected Stripe account
- Visionary Studios does not hold or store payment funds
2.2 Pricing
All prices are set by sellers. Buyers agree to pay the listed price at the time of purchase or winning bid.
Visionary Studios does not currently charge buyers a premium or service fee in addition to the listed artwork price. Visionary Studios reserves the right to introduce a buyer's premium or other buyer-facing fee in the future, at its discretion, with reasonable advance notice published on the platform. Any such fee will apply only to purchases and bids made after its effective date and will not affect any transaction already completed or in progress.
2.2A Platform-Funded Buyer Discounts
From time to time, Visionary Studios may offer a specific buyer a percentage discount off the listed price of one or more artworks, at its sole discretion. Where offered, such a discount is funded entirely from the platform's own 15% commission on that sale - it is never deducted from, and never reduces, the amount due to the seller.
(a) Discretionary and Limited. A buyer discount is a promotional benefit, not a right, and is never guaranteed on any purchase. The rate of any such discount is always limited so that it cannot exceed the platform's own effective commission on that specific sale. Visionary Studios will never offer, and a buyer should never expect, a discount that would require the seller to receive less than the price they listed the artwork for.
(b) No Stacking. Where a buyer discount and any other applicable platform-funded discount (such as a first-time buyer discount) could both apply to the same purchase, only the single more generous discount applies. Discounts are never combined or stacked on top of one another.
(c) Auction Lots Excluded. Buyer discounts do not apply to the final hammer price of any artwork sold at auction. Auction prices are determined solely through competitive bidding between bidders, and Visionary Studios does not discount, rebate, or otherwise adjust a winning bid after bidding has closed.
(d) Right to Amend or Withdraw. Visionary Studios reserves the right to modify, reduce, suspend, or discontinue any buyer discount at any time and at its discretion, upon reasonable notice where reasonably practicable. Any such change applies prospectively only and will not affect a purchase already completed or in progress.
2a. Bank Transfer Payment Terms
For purchases of €2,500 or above, you may elect to pay by direct bank transfer instead of card payment, subject to the platform's bank transfer setting being active.
By selecting bank transfer at checkout, you agree to the following:
- How it works: You are redirected to a secure Stripe checkout page, which generates a unique virtual bank account for your transaction on the seller's own connected Stripe account. You transfer the funds from your own bank account using those details.
- No seller approval needed: There is no seller approval step. Your order confirms automatically the moment Stripe confirms your funds have cleared — typically within 1–3 business days.
- Reservation window: Selecting bank transfer reserves the artwork for a limited window (typically 7 days). If your transfer is not completed and cleared within this window, the reservation expires automatically and the artwork becomes available to other buyers.
- Funds destination: Your payment settles directly into the seller's own Stripe account. Visionary Studios does not receive, hold, or have access to your funds or bank details at any point.
- Transfer liability: Visionary Studios is not liable for failed, delayed, misdirected, or fraudulent bank transfers.
- Identity verification: Purchases of €2,500 or above require successful identity verification before checkout can be completed. This is a one-time process conducted via Stripe Identity.
Risk in the artwork passes to the buyer upon confirmed delivery to the address provided at checkout, unless otherwise required by applicable consumer protection law.
Notwithstanding the platform’s neutral role, Visionary Studios reserves the right to take reasonable actions it deems necessary to protect users, prevent fraud, enforce these terms, or comply with legal obligations, including restricting accounts or suspending transactions where appropriate.
2b. Split Payment Terms
For eligible single-artwork "Buy Now" purchases, you may elect to pay in two parts: one portion by card, and the remaining portion by direct bank transfer. This option is also available to a winning bidder settling an auction lot, on the terms set out below. This option is not available for complete-series bundle purchases or multi-item orders.
By selecting Split Payment at checkout, you agree to the following:
- Minimum on each portion: Both the card portion and the bank transfer portion must be at least €100. You choose how the total price is divided between the two, subject to this minimum on each side.
- Order of payment: The card portion is charged first, through a standard secure Stripe checkout. A second secure Stripe checkout page then opens for the bank transfer portion, generating a unique virtual bank account for that remaining amount on the seller's own connected Stripe account, in the same way as a full bank transfer purchase under Section 2a.
- Reservation window: Once the card portion is paid, the artwork is reserved for a window of 7 days for completion of the bank transfer portion. If the transfer is not completed and cleared within this window, the reservation expires automatically, the artwork becomes available to other buyers, and the card portion already paid will be refunded in accordance with Visionary Studios' standard refund process for an expired reservation.
- Who may send the transfer: The bank transfer portion must be sent either from your own account, or from the account of one other named person or entity that you declare at checkout and identify by their relationship to you (for example, a company director, spouse, or business partner). You may not have the transfer sent by an undeclared third party.
- Name verification is a compliance check, not a payment block: Where technically available, the name associated with the received transfer is automatically compared against the name you declared. A successful match requires no further action. If the name does not clearly match, or is not made available to us by the sending bank, your order is flagged for manual review by Visionary Studios. This review step does not reverse, withhold, or reject funds already received by the seller's Stripe account; it exists solely so that Visionary Studios can verify the purchase and take any protective action reasonably necessary under Section 2a.
- Order confirmation: Your order confirms only once both the card portion and the bank transfer portion have been received and cleared. Until then, the order remains in a pending state and you will be notified separately as each portion is received.
- Funds destination: As with all bank transfer payments, your transfer settles directly into the seller's own Stripe account. Visionary Studios does not receive, hold, or have access to your funds or bank details at any point.
- Identity verification: The identity verification and due-diligence thresholds described in Section 2a apply to the total price of a split payment purchase, not to either portion individually.
All other provisions of Section 2a (transfer liability, risk passing on delivery, and Visionary Studios' right to take protective action) apply equally to the bank transfer portion of a split payment.
Auction settlement: Where you are settling a winning auction bid rather than a Buy Now purchase, Split Payment works the same way, applied to the amount owed at settlement under Section 3.2. If you had already arranged a deposit for a premium lot under Section 3.2a, that deposit is applied first, and the €100 minimum on each side and the division between card and bank transfer are calculated on the remaining balance after the deposit is deducted, not on the full hammer price.
3. Purchases & Bidding
3.1 Buy Now Purchases
- Purchases are final once completed
- Buyers commit to completing payment at checkout
3.2 Auctions
- Bids are binding commitments to purchase
- If you are the winning bidder, you are required to complete the transaction
- Auctions are available exclusively from Established and Principal sellers - all auction listings are subject to platform trust criteria
A valid payment method is required to participate in auctions.
3.2a Premium Lot Pre-Approval and Deposits
Auction lots at or above a threshold set from time to time by Visionary Studios ("Premium Lots") require individual, per-lot approval before you may bid, in addition to any general identity verification requirement under Section 3.3. You may seek this approval by any one of the following routes, as made available to you at the time:
- Bank reference: submitting a reference letter from your bank for our review.
- Arranged deposit: authorizing a hold on your payment card for an amount we specify (commonly around 10% of the lot's high estimate, though this may vary by lot).
- Fast track: where you have a qualifying prior approved bank reference or completed purchase at an equal or higher value within the relevant look-back period, as determined by us.
(a) Nature of an arranged deposit. Where you choose the arranged deposit route, the amount is placed as a hold (authorization) on your card, not an immediate charge. No funds are taken from you at the time of authorization, and the hold is placed directly against the relevant lot's seller's own payment account — Visionary Studios does not at any point hold, control, or have custody of the deposit amount.
(b) Duration and reauthorization. A card authorization hold is time-limited (ordinarily around 7 days) under standard card network rules. If the auction for the relevant lot remains open beyond that period, we will contact you to reauthorize the hold. If you do not reauthorize, the hold simply lapses with nothing charged to your card, and your approval to bid on that lot will need to be renewed before you may continue bidding.
(c) If you are not the winning bidder. Your deposit hold is released in full once the auction concludes without you as the winning bidder. No charge is ever made to your card in this circumstance.
(d) If you are the winning bidder. Your deposit is captured and applied toward your purchase price as part of completing the transaction in the ordinary course.
(e) Forfeiture. If you are the winning bidder and you fail or refuse to complete the purchase (including a failure to complete any required payment authentication within the applicable deadline), Visionary Studios reserves the right to capture and retain your deposit in full as compensation for the resulting loss to the seller, without further notice beyond what is reasonably practicable, and without obligation to return any part of it. This is distinct from, and in addition to, any other remedy available to the seller or to Visionary Studios arising from your failure to complete a binding winning bid.
3.3 Identity Verification for High Value Purchases
For enquiries and purchases of €2,500 or above, buyers are required to complete a one-time identity verification process. Verification is conducted by Stripe, Inc. via Stripe Identity. Visionary Studios receives only a verified or unverified status - your identity documents are held by Stripe and are not stored by Visionary Studios. This requirement exists to comply with enhanced due diligence obligations under EU anti-money laundering regulations.
3a. Platform Trust Badges
3a.1 Identity Verified Badge
The Identity Verified badge displayed on a seller's profile or listing indicates that the seller has successfully completed identity verification via Stripe Identity, a service operated by Stripe, Inc. Identity verification is required for buyers making purchases or cumulative auction bid exposure of €2,500 or above, in accordance with our anti-money laundering obligations under EU Directive 2018/843 (5AMLD).
Visionary Studios does not conduct identity verification directly. The verification process is carried out entirely by Stripe, Inc. via Stripe Identity. Visionary Studios receives only a verified or unverified status and the date of verification - identity documents (such as passport or driving licence scans) are held exclusively by Stripe and are not stored or accessed by Visionary Studios.
The Identity Verified badge confirms only that the relevant user has passed Stripe's identity verification process at the time of verification. It does not constitute an endorsement of the user's conduct, creditworthiness, intentions, or the authenticity of any artwork by Visionary Studios. Buyers should not rely on this badge as a substitute for their own due diligence.
3a.2 Verified Professional Badge
The Verified Professional badge displayed on a seller's profile or listing indicates that the seller has successfully completed Stripe Connect onboarding, including Stripe's standard Know Your Customer (KYC) identity and business verification process. This verification is conducted entirely by Stripe, Inc. and confirms that the seller has been accepted as a legitimate individual or business entity by Stripe for the purposes of receiving payment settlements through the platform.
Visionary Studios does not conduct independent verification of sellers beyond Stripe's KYC process and does not manually review or approve sellers on the basis of this badge. The Verified Professional badge is awarded automatically upon successful completion of Stripe Connect onboarding.
The Verified Professional badge confirms only that a seller has completed Stripe's KYC verification process. It does not constitute an endorsement, authentication, or appraisal of any artwork listed by that seller, nor does it guarantee the seller's conduct, the accuracy of their listings, the authenticity or provenance of their artworks, or any specific outcome in a transaction. Buyers remain solely responsible for conducting their own due diligence before purchasing.
3a.3 No Reliance on Badges
Trust badges displayed on the platform are provided for informational purposes only. They reflect the completion of specific third-party verification processes and do not represent any guarantee, warranty, or endorsement by Visionary Studios in respect of any user, artwork, transaction, or outcome.
Visionary Studios expressly excludes all liability for any loss, damage, or claim arising from a buyer's reliance on any trust badge displayed on the platform. All purchasing decisions are made at the buyer's sole discretion and risk.
3b. Authenticity, Provenance & Due Diligence
Limitation of Responsibility Regarding Authenticity - Please Read Carefully
Visionary Studios provides no authentication, certification, appraisal, attribution or valuation service of any kind. Nothing displayed on the platform - including listings, descriptions, trust badges, certificates of authenticity, catalogue raisonné references, provenance records or acquisition certificates - constitutes a representation or warranty by Visionary Studios that an artwork is authentic, correctly attributed, correctly described, or accompanied by accurate provenance.
All such information is supplied solely by the seller (the consignor). Platform review of a listing relates only to presentation and policy compliance and is never a verification of the artwork itself.
To the fullest extent permitted by law, Visionary Studios excludes all liability for any loss, damage or claim arising from an artwork being inauthentic, misattributed, misdescribed, or of disputed provenance or ownership. Any such claim lies against the seller as merchant of record. Buyers are solely responsible for their own due diligence and should obtain independent expert advice before purchasing.
Nothing in this section limits any statutory right you may have as a consumer against the seller under Irish or EU consumer protection law.
4. Shipping & Delivery
4.1 Seller Responsibility
Sellers are responsible for:
- Shipping the artwork safely and securely
- Providing tracking information where available
- Ensuring delivery to the address you provide
- All packaging, insurance, customs compliance, and export documentation
4.1a Shipping Address Responsibility
Buyers are responsible for ensuring that their shipping address is accurate at the time of confirmation.
Once submitted, the confirmed shipping address is shared with the seller for fulfilment and may not be modified through the platform. Any changes must be agreed directly with the seller via platform messaging. Visionary Studios does not verify, modify, or take responsibility for the accuracy of shipping information provided by buyers.
4.2 Delivery Timeframe
Unless otherwise agreed between you and the seller, artworks should be dispatched within a reasonable timeframe following payment confirmation. Under EU consumer law, where applicable, goods must be delivered within 30 days of purchase unless an alternative timeframe has been expressly agreed. Delivery times may vary depending on:
- Seller location and dispatch schedule
- Shipping method and carrier selected by the seller
- International transit times and customs processing
4.3 Non-Delivery Escalation
If your artwork has not arrived within the expected timeframe:
- First, contact the seller directly using the platform's order messaging thread
- If unresolved, contact our support team at support@visionarystudios.art with your order details
- If the matter cannot be resolved directly, you may initiate a payment dispute through your card issuer or Stripe - the dispute outcome is determined by Stripe and your issuing bank, not by the platform
- You retain your statutory rights under applicable consumer law regardless of platform policies
4.4 Customs Duties & Import Taxes
Buyers are responsible for any customs duties, taxes, or import fees applicable to their delivery. These charges are collected by the delivery company on behalf of customs authorities and are not included in the artwork price.
- From 1 July 2026, a €3 customs duty per distinct item applies to eCommerce packages valued at €150 or less entering Ireland from outside the EU
- Goods purchased from EU-based sellers do not attract customs duty within the EU
- Customs duties and import taxes are not refundable if you change your mind and return the artwork (they are only refunded if the goods are faulty)
- Buyers should check whether the seller is based in the EU before purchasing - the website name, '.ie' domain, or Euro pricing is not proof of the seller's location
Check what charges are applied at checkout and what is included in the delivery terms. If customs duties are not charged at checkout, additional charges may be incurred on delivery.
For the full VAT framework — including when Visionary Studios acts as deemed supplier for sales by non-EU sellers, and when import VAT is collected at customs — see the Terms of Service (Section 11a).
4a. Delivery Timeframes and Non-Delivery
4a.1 Expected Delivery Timeframes
Delivery timeframes vary depending on seller location, shipping method, and destination. Sellers are solely responsible for dispatching artworks within a reasonable timeframe following order confirmation. The platform does not monitor, control, or provide status updates on delivery progress. Any tracking information displayed on the platform is provided voluntarily by the seller and is not verified or managed by Visionary Studios.
4a.2 Seller Account Standing
Sellers are solely responsible for shipping, delivery, and fulfilment of orders. Any platform-level compliance measures relate only to seller account standing and do not constitute oversight, control, or responsibility for delivery. Visionary Studios does not enforce, track, or guarantee dispatch timelines and bears no liability for seller fulfilment failures.
4a.3 Non-Delivery
If your order has not been delivered within a reasonable timeframe and you have not received satisfactory communication from the seller, contact the seller directly via platform messaging. If the matter remains unresolved, you may contact us at legal@visionarystudios.art for information about your order record. Visionary Studios is a technology platform that facilitates connections between buyers and sellers. The platform is not a party to transactions and does not mediate, intervene in, or resolve disputes between users. All disputes must be resolved directly between the buyer and seller or through the user's payment provider or card issuer.
4a.4 Seller Payout Conditions
Seller payouts are subject to platform-defined release conditions as part of Stripe's payment infrastructure. These conditions relate solely to seller account standing and payout scheduling and do not represent platform oversight of, control over, or responsibility for the physical delivery of artworks. Visionary Studios does not hold, control, or escrow buyer funds at any stage.
4b. Room Visualizer - Buyer Rights & Responsibilities
The Room Visualizer tool allows you to generate digital preview composites showing artworks from our platform placed within your own room photos. By using the Room Visualizer you agree to the following:
- Room Visualizer composites are for personal preview and sharing purposes only and may not be used for commercial purposes without the written permission of the original artist.
- All composites include a visionarystudios.art watermark. You must not remove, obscure, or alter this watermark in any way.
- Room Visualizer composites do not constitute an accurate reproduction of the original artwork. Colours, scale, texture, and finish may vary from the physical piece. Always refer to the original listing for accurate representation before purchasing.
- By uploading a room photo you confirm that the image is your own or that you have the right to use it, and that it does not contain any content that violates the rights of any third party, including copyright, privacy rights, or any other intellectual property right.
4c. Presentation Imagery and Gallery Staging
Some imagery displayed on the platform — including the homepage and editorial features — may present artworks in digitally created or staged settings (such as gallery or museum walls) to show a work in an illustrative context. Such presentation imagery:
- is illustrative only and does not depict the actual current location, condition, framing, hanging, or ownership of the artwork;
- may be produced using digital tools, including AI-assisted generation, and colours, scale, texture and finish may vary from the physical artwork;
- does not constitute a representation by Visionary Studios that the artwork has been exhibited at, is hanging in, or is available to view at any gallery, museum, or other venue;
- where it forms part of a paid placement, is disclosed as such (for example, by a "Featured placement" line on the presentation label).
The authoritative representation of each artwork is its listing, including the seller-supplied photographs, description and any accompanying documentation. Buyers should rely solely on the listing when deciding to purchase, and Visionary Studios accepts no liability for any reliance on presentation imagery.
5. Communication
5.1 Platform Messaging
- Communication between buyers and sellers occurs within the platform
- Contact details (email, phone, social media) are not shared
5.2 Off-Platform Communication
Attempting to move transactions or communication off-platform is prohibited.
5.3 Essential Account Notifications
Notifications relating to orders, payments, delivery, account security, refunds, withdrawals, and disputes are sent to you by email and shown in the platform's in-app notification centre, and cannot be switched off, because they carry time-sensitive or legally relevant information (for example, a seller's response deadline on a refund request). You may opt out of non-essential notifications — such as outbid alerts or news from artists you follow — from Settings, without affecting essential notifications.
6. Disputes, Chargebacks, and Buyer Recourse
6.1 Platform Refund Request Process
Separately from a Stripe chargeback (see 6.2 below), the platform offers a direct Refund Request as a faster, in-house alternative. You may open a Refund Request from your Orders page for a stated reason (for example: item not as described, item never received, item arrived damaged, change of mind, or another reason), with supporting details. Opening a Refund Request does not affect, waive, or substitute for your statutory right of withdrawal (Section 7a) or your ability to raise a chargeback with your card issuer at any time.
Once opened, the seller has 72 hours to approve or decline the request. If the seller approves, the refund is processed immediately to your original payment method. If the seller does not respond within 72 hours, Visionary Studios may process the refund on your behalf under platform policy, without that action being a determination of fault or merits on either side — it is a procedural step to keep the process moving, not an adjudication of the underlying disagreement.
Except where your reason is that you never received the artwork, approval of a Refund Request (whether by the seller or by the platform) requires you to return the artwork to the seller, at your own cost, within a reasonable time. The platform will show you a suggested return-by date and may send reminders, but this is a guideline to keep the process moving smoothly — it does not shorten, extend, or otherwise affect your underlying refund entitlement once a Refund Request has been approved. Visionary Studios does not verify that a return has actually taken place; that confirmation is the seller's own responsibility.
6.2 Stripe Chargeback Process
All payment disputes are handled through Stripe's chargeback process. If you have a concern about a transaction, you may initiate a dispute through your payment provider or card issuer. Sellers are notified of disputes and are required to submit evidence through the platform. Stripe determines all dispute outcomes in accordance with card network rules. Visionary Studios does not control, influence, or guarantee the outcome of any payment dispute or chargeback process. Visionary Studios does not guarantee the recovery of funds under any circumstances, including in cases of fraud, dispute, or failed transactions.
6.3 Platform Role in Disputes
Visionary Studios does not mediate disputes regarding artwork condition, authenticity, or buyer satisfaction, and does not act as an arbitrator between buyer and seller. The platform may provide relevant transaction data, order records, and communication logs to Stripe where requested in connection with a dispute. Visionary Studios does not investigate disputes or make determinations regarding fault, liability, or entitlement to refunds.
6.4 Transaction Records
The platform maintains transaction records, which users may independently use in support of disputes with their payment provider or card issuer. When a chargeback is raised, the platform provides the seller with a structured documentation panel to compile and submit supporting evidence to Stripe on the seller's behalf; the platform does not adjudicate the dispute, and the outcome is determined independently by Stripe and the buyer's issuing bank. Users may contact legal@visionarystudios.art to request access to their own transaction records. Visionary Studios may retain and review platform data, including messages and activity logs, for the purposes of fraud prevention, compliance, and enforcement of these terms. The platform does not verify the accuracy, completeness, or evidential value of any such records.
6.5 Seller Compliance Action
Where a buyer dispute reveals evidence of seller non-compliance - including failure to ship, provision of false tracking information, or fraudulent misrepresentation - the platform may take independent compliance action against the seller under our seller risk framework, including account suspension and referral to relevant authorities. Such action is taken to maintain marketplace integrity and does not constitute platform liability for the underlying dispute.
6.6 Your Statutory Rights
Nothing in these Buyer Terms limits any statutory rights you may have as a consumer under Irish law or applicable EU law. If you are a consumer resident in the EU, you retain all rights available to you under applicable consumer protection legislation, including the right to seek redress through national consumer protection authorities such as the Competition and Consumer Protection Commission (CCPC) at ccpc.ie. You may also submit a complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
6.7 Bank Transfer Transactions
Bank transfer payments are processed by Stripe directly into the seller's connected Stripe account. Because bank transfers are not card payments, they are not eligible for a card chargeback. Visionary Studios does not provide dispute resolution, refunds, or payment recovery services for bank transfer transactions. If a transfer is sent in error, contact the seller and Stripe support immediately - transfers cannot be reversed once sent.
7. Refunds & Statutory Rights
7.1 Your Statutory Rights
Nothing in these Buyer Terms affects your statutory rights under applicable consumer law. Where applicable, you retain rights including:
- Goods as described: Sellers must supply artworks as described in the listing. If an artwork materially differs from its description, you may have remedies directly against the seller as merchant of record.
- Delivery: Artworks should be delivered within the agreed or statutory timeframe (30 days under EU consumer law where applicable).
- Remedies: Where goods are not as described or not delivered, you may be entitled to a repair, replacement, price reduction, or refund directly from the seller, or may initiate a dispute through Stripe and your card issuer.
7.2 Refunds
All sales conducted through the platform are transactions directly between the buyer and the seller. Visionary Studios does not process, issue, or determine refunds.
Any request for a refund must be directed to the seller in accordance with their individual terms and applicable law.
If a buyer is unable to resolve an issue with a seller, they may pursue a payment dispute or chargeback through their payment provider or issuing bank. Such processes are handled entirely by the relevant financial institutions, and Visionary Studios does not participate in or control their outcomes.
7.3 Dispute Outcomes
Where a payment dispute or chargeback is initiated, outcomes are determined by Stripe and your card's issuing bank - not by Visionary Studios. The platform does not adjudicate dispute outcomes. Your right to raise a dispute with your card issuer is unaffected by any platform policy.
7.5 Platform Role
Visionary Studios acts solely as a technology platform enabling listings and transactions between independent buyers and sellers. The platform is not a party to any transaction, does not take title to goods, and does not assume responsibility for product quality, delivery, authenticity, or post-sale outcomes.
7a. Right of Withdrawal and Returns
7a.1 Statutory Right of Withdrawal
Where you are a consumer purchasing goods through the platform under a distance contract from a seller acting as a trader (a business), you have a statutory right of withdrawal under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (transposing EU Directive 2011/83/EU). This right allows you to withdraw from the contract within 14 days of receiving the artwork without giving any reason.
7a.2 Business vs. Private Sellers
The 14-day right of withdrawal applies only where the seller is acting as a trader (i.e. a business - such as a gallery or professional artist selling in the course of a business). It does not apply to sales by private collectors acting as private individuals selling their personal collections. Sellers on the platform are designated as Artists, Galleries, or Private Collectors. You should check the seller type indicated on the listing to understand whether the statutory right of withdrawal applies to your purchase.
7a.3 Exemptions
The following exemptions may apply to the right of withdrawal:
- Commissioned or bespoke artworks: Goods made to the consumer's specifications or clearly personalised are exempt from the right of withdrawal. If you commission an artist to create a bespoke or custom artwork through the platform, the 14-day right does not apply.
- Auction purchases: Purchases made through the platform's auction facility are not subject to the statutory right of withdrawal. A winning bid constitutes a binding contract of sale (see Section 7a.5 below).
- Sealed goods unsealed after delivery: Where applicable, goods that have been unsealed after delivery are exempt.
The platform's position is that unique, one-of-a-kind original artworks may fall within an exemption from the right of withdrawal. However, this is a legal interpretation that may be subject to review and may vary by jurisdiction. Where a listing is not exempt, the seller's withdrawal and returns policy will be stated in the listing.
7a.4 How to Exercise Your Right of Withdrawal
If you wish to withdraw from a purchase within the 14-day period, you should:
- Notify the seller of your decision to withdraw by sending a clear statement (e.g. via platform messaging) within 14 days of receiving the artwork
- Use the platform's standard Withdrawal Form if you wish to use a template
- Return the artwork to the seller at your own cost (unless the seller failed to inform you of the cancellation right, in which case the seller bears return costs), without undue delay and in any event within 14 days of communicating your withdrawal decision. Your Orders page will show this return-by date and may send you reminder emails as it approaches, as a courtesy — these reminders do not themselves change your legal obligations.
- The seller must refund you within 14 days of receiving your withdrawal notification, including the original delivery charge. If the seller does not do so, Visionary Studios may process the refund on your behalf under platform policy, as a procedural step rather than a ruling on the merits.
Visionary Studios is a technology platform and is not a party to transactions. The platform does not mediate, intervene in, or resolve disputes between users. Any refund arising from a valid withdrawal is the sole responsibility of the seller as merchant of record. All such matters must be resolved directly between the buyer and seller or through the user's payment provider or card issuer.
7a.5 Auction Purchases
Purchases made through the platform's auction facility are not subject to the statutory right of withdrawal. A winning bid constitutes a binding contract of sale.
7a.6 Customs Duties and Taxes on Withdrawal
Where an artwork has been imported from outside the EU and customs duties or import taxes have been charged at delivery, these charges are not refundable by customs authorities upon withdrawal (unless the goods are faulty). If you exercise your right of withdrawal and return the artwork, you will not recover any customs duties or import taxes paid. The seller is only required to refund the artwork price and original delivery charge. You bear the cost of returning the artwork and any customs duties or taxes that cannot be recovered.
7a.7 Seller Refund Policies
Individual sellers may offer returns or refunds beyond the statutory minimum at their own discretion. Any such policy is between you and the seller. Visionary Studios does not fund or administer seller-discretionary refunds.
7b. Alternative Payment Methods
For purchases of €2,500 or above, buyers may elect to pay by direct bank transfer at checkout via Stripe, subject to the platform's bank transfer setting being active. Card payment is available for all purchases. See Section 2a for full bank transfer terms, including reservation windows, automatic confirmation, and identity verification requirements.
For any questions about payment methods, contact support@visionarystudios.art.

To maintain marketplace integrity, Visionary Studios may:
- Restrict or block accounts

8a. Platform Safeguards and Administrative Actions
Visionary Studios may take administrative or system-level actions to maintain platform integrity, including but not limited to:
- placing temporary holds on payouts
- cancelling transactions in cases of suspected fraud or technical error
- processing payment adjustments where required for compliance or system protection
These actions are performed as platform safeguards only.
Visionary Studios does not act as an intermediary, broker, or dispute resolution body, and does not assess or determine the merits of disputes between buyers and sellers.
All transaction disputes are handled between users or through the relevant payment provider.
9. Limitation of Liability
To the maximum extent permitted by law:
- Visionary Studios is not responsible for transaction outcomes between buyers and sellers
- Card payment processing is handled by Stripe; bank transfers are made to a Stripe-generated virtual bank account that settles directly into the seller's connected Stripe account
- Liability for payment dispute outcomes rests with Stripe and the issuing bank
To the fullest extent permitted by law, the total aggregate liability of Visionary Studios and MTSTGEORGE LTD arising out of or in connection with a specific transaction shall not exceed the total platform fees actually received in respect of that transaction.
Where a claim does not arise from a specific transaction, the total aggregate liability of Visionary Studios and MTSTGEORGE LTD shall not exceed the total platform fees actually received from the user in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in this section excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded under applicable law.
9.1 Data Security and Unauthorised Access
We apply appropriate technical and organisational measures to protect your personal data, as set out in our Privacy Policy. No method of electronic storage or transmission is entirely secure, and you acknowledge the inherent risks of transmitting information over the internet.
To the fullest extent permitted by law, Visionary Studios is not liable for any loss or claim arising from unauthorised access to, interception of, or disclosure of data - including hacking, malware, phishing, credential compromise or other criminal interference - whether directed at Visionary Studios, at a third-party provider, or at your own systems or accounts.
Your payment card details and identity documents are never held by Visionary Studios. They are submitted directly to Stripe, Inc., which acts as an independent controller of that data, and we accept no liability for security incidents occurring within Stripe's systems. Nothing in this section limits liability that cannot lawfully be excluded, including our mandatory obligations under the GDPR and the Irish Data Protection Act 2018.
9.2 Your Rights Under EU/UK Consumer Law
If you are an EU or UK consumer, you retain all rights granted under applicable consumer protection law. Nothing in these Buyer Terms constitutes a waiver of those rights. You may bring proceedings in the courts of your country of residence and may access applicable ADR (alternative dispute resolution) schemes.

- These Buyer Terms
- The Terms of Service
